You can think about this... as well as about the comparison of the concepts of "legal adviser" and "lawyer".
It seems that in one of my higher education diplomas there is the word "lawyer"...
A practicing lawyer does not necessarily deal with criminal cases, and he does not necessarily participate as a representative of a party in any judicial process.
On the contrary, it is often much more profitable for the client if the situation is resolved without a judicial process. Whether such option is profitable for a lawyer - it is an independent [a seperate] question...
One day a businessman came to me with a request to help him in the proceedings regarding an unpaid debt. A rather complicated judicial perspective was creating up, with a rather difficult evidence.
I asked who the debtor was. It turned out that the debtor is located in some nearby office and is not hiding anywhere.
Soon I, the offended creditor and the debtor met on someone's territory...
I outlined our (with the client) plans and roughly determined the costs of the debtor-regardless of the outcome of the case. Does it make sense to dive into the proceedings?
A few days later, the client reported that the debt was fully or partially repaid. He, the client, is generally satisfied.
Or another example. The client informs that in the bank where his company has opened a foreign currency account, they demand to conclude a new contract for banking services. The company's costs in this regard are sharply increasing. I, having clarified some details, advised not to rush to sign a new contract.
The case dragged on. All the bank's clients switched to the new terms. Only the client's company remained with the old type of contract. So it remained - for years. Based on indirect signs, I estimated the monthly benefit of the client in the range from 1000 to 5000 US dollars.
However, let's think about the principle that is indicated in the name of this miniature.
With this principle in mind, we can recall an interesting case that was not related either to criminal cases or to my participation (as a representative) in court proceedings.
One energetic person discovered a crumbling architectural monument (old building) in a large city. The monument needed reconstruction. The man prepared a beautiful painting of what this object should become in the future (he proudly showed me this picture - in color, on a large sheet of whatman), and for the purpose of reconstruction he received a loan of two hundred million rubles. It was a very long time ago, so I find it difficult to translate this amount into US dollars. Anyway, it was very noticeable money.
Time passed, the reconstruction was moving sluggishly, it was time to pay off the loan. The bank sent this person a letter demanding to return the money.
It was necessary to develop a line of conduct.
After several discussions, the client received - as they said in Ancient Rome - a "formula" and went to solve his problems.
Somehow everything calmed down.
A long time passed. A call came from this person. The topics of the call were questions about the money that he allegedly paid me, and the return of this money in his favor.
I answered laconically.
Apparently, in all this scheme, in all this plan an important place was occupied by the recording of a telephone conversation. An energetic person wasn't able to get the needed record. So he stopped calling me.
Once I was crossing the street at a green traffic light and felt someone's eyes on myself. I turned my head and saw on the side of me, behind the wheel of a foreign car that had stopped and was letting pedestrians pass, an energetic man who was looking at me through the windshield with a kind irony.
I walked on, the traffic light switched, the cars moved. I never saw this man again. Maybe he became a resident of Rome and sometimes remembers the "formula", that he recieved?
I read the information by the bankruptcy trustee in one of the newspapers. The bank, where the loan was taken by an energetic person, went bankrupt. A manager was appointed to the bank, who began to collect debts on loans. Among those listed was the case of an energetic person. The bankruptcy trustee informed the public that he failed to recover the debt from an energetic person - only photocopies of documents were at the disposal of the new (temporary) administration of the bank, and the photocopies were unsuitable for the trial. So the energetic person remained with his own.
The object was not restored, it seems, for twenty or forty years after all this history.
Or another (second) case. It was connected with a very complex legal dispute between one of the businessmen and a very, very large organization.
As a result of the proceedings, the businessman received not the amount he had hoped for, but about a third or a quarter of what was expected. If we take into account the size of a large organization and its influence, as well as the complexity of the case and the complexity of the evidence, then this result was an unexpected success.
When everything was over, and he received his money (quite large), he started an unpleasant conversation with me about the return of the money allegedly previously paid to me.
From the general context, it was clear that he was going to turn to some exclusive opportunities at his disposal.
From my answers, he apparently concluded that things would not go as smoothly as he could have expected.
At last, he smiled and disappeared forever.
To illustrate the principle, set forth in the title of this miniature, other examples can be given, but they do not correspond in volume to a short, compact work.
